Again: one side is arguing against Tumblr antis, the other is arguing against "Fuck you don't take my child porn", and neither of those are what's actually going on on either side.
Okay. But here's the thing. Nobody here is actually smutting with minors, at all. I guess there's some question if pg-13 fade-to-blacks with no discussion of the actua hows and whats and wheres and whatever is going on, only discussion, maybe, of the emotionals hows, in a narrative, counts as smutting with a minor?
Okay, that's fair! I still don't think FTBs are particularly sexual but my boundaries aren't anyone else's and so on and so forth. I'm mostly just trying to throw policy drafts at the wall to see what might work! :) Anyways! I do think it's in general important to remind everyone that OOC communictaion is super important and that you should never escalate a scene without first being sure the other party is comfortable with it. Aside from that there however remains the problem that honestly kind of has me stumped, on how we're gonna ensure this policy actually works though? :c Like I know there's a sub-account list to go with the SPR however idk if everyone's posted in there yet and if everyone has actually listed all their subs. So we're down to 'This would actually require 100% cooperation from all minors in RP-Spaces, and outing relevant subaccounts.' Since I'm "outing" my subs voluntarily I'm not affected by this but there might be some who would be not okay with this? Idk. I want everyone to be comfortable but I dunno how to make sure everyone is.
I do agree on the better age check since now that I think about it it is way too loose for any sort of liability discussion. And like. I don't want someone under 8 in my 18+ rps, even if they're not super smutty rps, because that's my space to rp with other adults?
OK, but to the best of my knowledge, that has happened exactly once, the minor initiated it, and it's not ever going to happen again. ETA: and it was an FTB, no actual pornographic content was posted.
Yeah, I keep saying/trying to remember to say KNOWN minors specifically, because we can't stop people from lying on the internet. That doesn't mean we shouldn't have rules, just that it's dicey sometimes.
That's not how the Miller test works. The state has the burden of proving there is no other value to the communication. Considering the authors in the rp are pretending to be fictional characters, there is at least some artistic value to it.
If a Fade-To-Black is too much then that can just be a new policy going forward, btw. Clear boundaries are important.
I'm not being sarcastic with that last line, mind you, if we need to cater to the person that is the most uh... I don't want to use the word sensitive but it's the only word coming to mind? Basically, if we have to lock down to the lowest rating then it would be safer in the long run to lock all of the rp forums behind 18+ That would suck, sure, but there IS always the chance that shit could slip because RP is Improv. Again, I'm being legit here. If we can do that, from what I'm seeing, it would be the safest way to do it.
IDK. I'm the one who stuck to using words with clearly obvious meanings and you're the one who is using a lot of words with implications but no clear meaning at all. I mean what the hell is "sex-adjacent"? So far as I can tell it is "acknowledging that sex exists and people have it".
Alix brought this up earlier, and it's clearly relevant. It's a problem on other sites. Why wait on a rule until something that's a problem on other sites migrates? ^ Just on this page while I was typing. Problem on other sites. It's definitely happened on Cherubplay, because I help with combs for bannable content for the admin over there. I challenge you to convince a judge that 14 year old Susie roleplaying as her OC Sally and having hawt lemon xD smexy timez with 28 year old Todd has artistic value. ;-P
Oh, this is cute! You asked me for a citation, and when I pulled one off Cornell's Legal Information Institute, you decided you didn't like it and that meant I was pretending to be a lawyer. I'm not pretending to be a lawyer. I do know how to read, though. And I'm very good at copy-pasting, if I do say so myself.
if fade-to-blacks with adults and their adult characters are banned in the spr, i will face god and walk backwards into hell
"Sex-adjacent" may well include "fade to black which strongly implies that a sex happened". We have at least one person who thinks it's definitely okay to have (with consent) a Fade To Black in an RP with a minor, and at least one person who thinks it's definitely not, so that's certainly an argument.
Wow, fuck you, Khan. Unless I guess everything you write is along the same lines of artistic merit as the shittiest original fiction ever written, because that's how stuff works now, I guess?
Right, and we're all agreed that that should not be allowed here. Why are you dragging in FTB scenes written by adults to this argument?
Also, if we're worried about legality: What level of violence is acceptable? Abuse? Which rating scale are we going by?
